1. Who we are

Ritmo is a service of YRD SOLUTIONS S.R.L., tax ID 50377628, Trade Register no. J13/2265/2024, registered office at Șos. Mangaliei nr. 57, bl. SM1, sc. B, et. 1, ap. 50, Constanța, jud. Constanța, România ("we"). You can write to us at support@ritmo.social.

These terms apply to the Ritmo app for iPhone and to the site ritmo.social. By using the service you accept them. If you do not agree, please do not use the service.

2. What the service does

Ritmo helps you prepare social media posts: from your answers about your business, an artificial intelligence model writes the text, and the app sets it in templates made by designers, as images and video clips you can edit and download.

Posts can use pictures from the Ritmo gallery or pictures you add. Publishing to Instagram, TikTok or anywhere else is done by you, outside the app.

3. Your account

You need an account, created with your email address and a code sent by email. The account is personal: you are responsible for what happens in it and for keeping access to your email address.

The service is for people aged 18 or over who use it for a business, a profession or a project of their own.

4. Free posts, subscriptions and packs

Every person gets 7 free posts, once. After them you need a subscription.

Subscriptions give a number of posts per calendar month (30, 100 or 500, depending on the plan), paid monthly or yearly. Posts not used in a month do not carry over to the next.

With an active subscription whose monthly posts are used up, you can buy packs of extra posts. Posts from packs do not expire while the account exists.

A post counts as used when the app plans or writes it for you. Deleting a post does not give it back.

5. Payment, renewal and cancellation

Subscriptions and packs are bought through the App Store and billed by Apple, at the price shown in the app before you buy, in the currency and with the taxes of your country.

A subscription renews automatically at the end of each period, at the price then in force, until you cancel it. You can cancel at any time in Settings → your Apple ID → Subscriptions, at least 24 hours before renewal. After cancelling you can use it until the end of the period you paid for.

You can move to a larger or smaller plan in the app at any time; Apple applies the change under its own rules. Refunds for App Store purchases are requested from Apple.

We may change prices for future periods. Apple tells you beforehand, and the change applies only if you do not cancel.

6. Right of withdrawal

If you are a consumer, you normally have 14 days to withdraw from a contract concluded at a distance. For digital content supplied immediately, such as generated posts, that right is lost once supply has begun with your agreement: by buying and using the subscription or pack, you ask for supply to begin immediately and acknowledge that you lose the right of withdrawal for what has already been supplied.

Withdrawal and refund requests for App Store purchases are made to Apple, which took the payment.

7. Your content

What you put into the app (the details of your business, the text you write or change, your logo and your pictures) remains yours. You give us the right to store and process it only as far as the service needs to work for you.

You confirm that you have the right to use what you upload, including pictures showing other people or brands.

You may use the posts made with Ritmo freely, commercially included, for your business.

8. Text written by artificial intelligence

The text is generated automatically and may contain mistakes, unsuitable wording or inaccurate statements about your business. Read and correct every post before you publish it: what you publish is your responsibility.

We do not promise commercial results (customers, sales, followers) from using the posts.

9. Ritmo pictures and templates

The templates, the gallery pictures, the sounds and the other materials in the app are ours or licensed to us. You may use them in the posts you make with Ritmo for your business.

You may not extract, resell or distribute them apart from your posts, or copy the app or its templates.

10. Acceptable use

Do not use the service for content that is illegal, misleading, defamatory, hateful or that infringes the rights of others, for spam, or to pretend to be someone else.

Do not try to get around the post limits, to reach the data of other accounts or to overload the service. We may suspend or close accounts that break these rules.

11. Availability and changes

We work to keep the service available and correct, but we do not guarantee that it runs without interruptions or errors. Generating posts needs an internet connection and outside providers, which can be unavailable.

We may change, add or remove features and templates. If a change substantially reduces a subscription you paid for, you may cancel it.

12. Liability

As far as the law allows, our liability for loss connected with the service is limited to the amount you paid for the service in the last 12 months. We are not liable for indirect loss, such as lost profit.

Nothing in these terms limits the rights the law gives you as a consumer, or liability that cannot be limited by law.

13. Closing your account

You can delete your account at any time in the app, in Settings → "Delete account and data". Deletion is final and does not cancel a subscription: that is cancelled separately, in Apple's settings.

After deletion we keep only a one-way fingerprint of the email address, so that the free posts are given once to each person. See the Privacy policy for details.

14. Complaints and disputes

If something is wrong, write to us at support@ritmo.social. We answer within 30 days.

If you are a consumer and are not satisfied with the answer, you may contact the Romanian National Authority for Consumer Protection (anpc.ro) or use its platform for the alternative resolution of disputes (SAL): https://reclamatiisal.anpc.ro/

These terms are governed by Romanian law. Disputes that are not settled amicably fall to the courts of Romania; consumers keep the protection of the law of their country of residence.

15. Changes to these terms

We may update these terms. The current version and its date are on this page. If a change is important, we tell you in the app or by email before it applies.
